Our Privacy Policy was updated on May 26, 2020.

Protecting the personal privacy has always been a prominent feature of Eta a.s. and its affiliates (hereinafter referred to as "Eta" or "We"). Since its establishment, Eta has always protected the confidentiality of each user's information, unless the individual user agrees to publish its personal information or personal results. Eta protects the identities of individuals in the same way who visit the Eta website.

Our commitment

The Privacy Policy stipulates how Eta and its affiliates collect, use, disclose, process and protect the information you provide to us when visiting our website. If we ask you to provide certain information in order to verify your identity when using the site, we will use such information only in strict compliance with this Privacy Policy and/or our User Terms and Conditions.

This Privacy Policy has been formulated with your needs fully in mind. It is important that you fully understand our practices for the collection and use of personal data and feel confident that you ultimately control the personal information provided to Eta.

What information is collected and how is it used?

Category of information collected

1. Information collected by Eta website

Eta collects information in two ways: (1) indirectly (for example, through the technology of our website), and (2) directly (for example, when you, as a visitor to our website, volunteer to provide information on various pages).

1.1. Information indirectly collected

When you use the Eta website, Eta will collect all kinds of information in an indirect way. Such information may include, but is not limited to, browser and device information, data collected through automated electronic data interchange, application usage data and other information (hereinafter referred to as "other information").

If we combine the other information with personal information, we will treat the combined information as personal information.

1.2. Cookie

Some types of information collected indirectly are stored in "cookies". Cookies are small files of electronic information that a website can send to a visitor's hard drive to help them when they visit the website. There are several different types of cookies:

Basic Cookies are used to provide basic functionality to visitors through our website. Without these cookies, the site will not function properly.

Analyzing the usage statistics of Cookies to collect information anonymously. This information helps us understand how visitors use the site.

Marketing Cookies help Eta improve the ads displayed on third-party websites and allow third parties to determine advertising effectiveness by gathering the necessary information about how the site is being used.

1.3. Information directly collected

Eta also collects personal and other information voluntarily provided by users. It is entirely up to you to provide the requested information.

All information collected directly by Eta is confidential and used only for the specific purpose stated at the time of collection. If it needs to be used for any other purpose, Eta will seek your express permission. You can choose to delete that information at any time. Eta will not exchange or trade your information with others, nor will it sell your information without your express consent.

1.3.1. User account data

When you set up an account on the Eta website (hereinafter referred to as the "user account"), the website may ask you to provide personal information, including but not limited to your name, email address and telephone number.

When you register as a customer/user of Eta to use any of our websites or any of our services, or when you provide feedback about our products or services, we may obtain your personal information. Such processing is necessary for the performance of the contract entered into with you in accordance with Section b), Article 6 (1) 1, GDPR. We will use your personal information for the following purposes, except where prohibited by law:

To communicate with you about your account and to send you our policy changes.

When you decide to terminate your user account, we will no longer store any of your user account data. In the event that we are obliged to continue to store your personal information due to statutory retention requirements, Eta will no longer use your personal information and we will only store such information until the expiration of the aforementioned retention period.

1.3.2. Other personal information directly provided

The personal information you provide on the Eta website (for example, information provided through a contact form or telephone) will be stored in our service database, according to Section b), Article 6 (1) 1, GDPR, they shall be retained for the period of time necessary for us to fulfill our contractual obligations to you, unless a longer period is required by law.

How the information is used

2. General information about information collection and processing

2.1. Information safety

The employees of Eta understand the need for user privacy, and we maintain reasonable and appropriate security procedures to protect your information from being lost, abused, unauthorized accessed, disclosed, altered and damaged, while giving due consideration to the risks involved in information processing and the nature of your personal information. Eta assigns a legal officer to monitor privacy practices. Access to user data is strictly limited to specific individuals trained by user privacy protection.

2.2. Third-party information storage

We provide personal information to our affiliates and other trusted businesses and persons who process it on our behalf, provided that such parties comply with our instructions and our Privacy Policy and any other related confidentiality and security measures. For example, we use service providers such as AliCloud for data storage. Any of our suppliers or agents shall not use the personal information we provide to them for any purpose other than the performance of the services stipulated in the contract with them. The same as Eta, they will not exchange or trade your information with others, nor will it sell your information without your express consent.

2.3. You fully understand that we do not need your consent to collect and use personal information in any of the following circumstances:

2.3.1. Those related to the security of the state and national defense;

2.3.2. Those related to public security, public health or major public interests;

2.3.3. Those related to criminal investigation, prosecution, trial and execution of judgment;

2.3.4. For the purpose of safeguarding the life, property and other important legitimate rights and interests of the subject of personal information or other individuals, but it is difficult to obtain consent from the individual;

2.3.5. The collected personal information is disclosed to the public by the subject of personal information;

2.3.6. Your personal information collected from lawful public disclosure, such as lawful news reports, government information disclosure and other channels;

2.3.7. Those necessary to conclude the contract according to your requirements;

2.3.8. Those necessary to maintain the safe and stable operation of the products and/or services provided, such as discovering and dealing with faults of the products and/or services;

2.3.9. Necessary for legitimate journalism;

2.3.10. When it is necessary for an academic research institution to carry out statistics or academic research based on the public interest and provide the results of academic research or description, the personal information contained in the results shall be de-identified.

3. Children and privacy

Eta encourages parents and guardians to spend time with their children online and familiarize themselves with the sites their children visit. The Eta site does not contain contents widely considered inappropriate for children.

 

Your rights

You have the rights to access your personal information held by us, and you have the rights to correct, update, amend, disable, delete or modify any of your personal information if it is incorrect. When you update your personal information, we may need to verify your identity before acting on your request.

You may also object to the use or processing of your personal information, or revoke your permission to use your personal information at any time if you are subject to the EU General Data Protection Regulation.

In accordance with the EU General Data Protection Regulation, you have the following rights in the treatment of your personal information:

The right to obtain free of charge (i) the information related to whether or not your personal information is retained (ii) access rights to your personal information and/or (iii) copies of your personal information retained. However, we reserve the right to charge a reasonable fee (taking into account the administrative costs of providing the contents of the information or communication or taking the requested action) or to refuse to carry out such requests if they affect the rights and liberties of others, are obviously unwarranted, or are excessive;

Rights to request appropriate correction, deletion or limitation of your personal information;

If the processing of your personal information is based on your consent, or if it is necessary to carry out a contract with you, and the related processing is implemented in an automatic way, you have the rights to obtain personal information about you in a structured, commonly used, computer-readable format or to transfer your personal information directly to other companies where technically feasible (data portability);

If the processing of your personal information is based on your consent, you have the rights to cancel your consent at any time without affecting any data processing activities that occurred prior to the cancellation of your consent, or any other existing evidence of legal justification for such processing activities; the rights not to be bound by any automatic decision that is personal, has legal effect on you or significantly affects you in a similar manner; and

The rights to take legal action and lodge a complaint with the data protection regulatory authorities if the processing of your personal information infringes your rights.

You may, at any time, object to the processing of your personal information in accordance with Section f), Article 6 1), GDPR in order to protect our legitimate interests. The foregoing section describes in detail our processing activities and legal basis. If you object, we will no longer process your personal information unless there is a credible and strong legal reason that the processing of the data is necessary to establish, enforce, or defend a legal claim. If you object to such processing, we will ask you to state the reasons for your objection so that we can review the treatment of your personal information and decide whether to adjust the treatment accordingly.

Please note that the processing of your personal information may involve advertising campaigns as described above. If you do not wish us to process your personal information for the purpose of conducting direct marketing activities, you may, at any time, send an email to vysavace@eta.cz to express your objection free of charge.

We have the rights to refuse to deal with unsubstantial/entangled duplicate requests, requests that impair the privacy of others, requests that are extremely unrealistic, requests that require disproportionate technical work, and requests that are not required to be given under local laws, information that has already been made public, and information that is given under confidential conditions. We may also deny the request to delete or access the data if we believe that certain aspects of the request might prevent us from lawfully using the data for the foregoing anti-fraud and security purposes.

Privacy Policy updates

We review this Privacy Policy periodically and may update it to reflect changes in our information practices. If we make a material change to this Privacy Policy, we will publish it via email (to the email address designated by your account) or on the Eta website or notify you via mobile device so that you can understand the information we collect and how we use it. Such Privacy Policy changes will apply from the effective date of the notice or the website. We recommend that you visit this website regularly for the latest information on our privacy practices. Your continued use of the products and services on the website, mobile phone and/or any other devices will be deemed to be acceptance of the updated Privacy Policy. When we collect additional Personal Information from you or we wish to use or disclose your Personal Information for new purposes, we will  seek your consent again.
